THC, cannabis and hemp products
Colorado Revised Statutes 25-5-427(4)(c)
(I) A person shall not: (B) Market or promote a hemp product as containing THC or any other potentially intoxicating cannabinoid.
This provision applies to ALL forms of THC including Delta 8, Delta 9, THCA, THCP, HHC or similar derivatives. Total permitted THC content in any hemp product is 1.75mg per serving with no more than 15:1 ratio of CBD to TOTAL THC.
These products may be labeled as less than 0.3% Delta 9 THC or compliant with the farm bill. However, they are not compliant with Colorado State Law and by extension the Aurora Municipal Code.
CBD products must contain a label that states they have less than or equal to 1.75mg Total THC per serving. They have at least 15:1 ratio of CBD to total THC. If they have more than 1.25mg total THC per serving and less than a 20:1 CBD to total THC ratio, they must be labeled that they can only be sold to persons over the age of 21.
Loose sales of hemp buds are prohibited as they do not meet the labeling requirements.
The product can contain de minimis levels of total THC per the limits above but cannot market or promote that it is a THC product.
