NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the name of RE or grant recipient.

REQUEST FOR RELEASE OF FUNDS

On or about April 15, 2024, the City of Aurora will submit a request to HUD for the release of HOME ARP funds under the HOME Investment Partnership Program, as amended. This undertaking will be for the Aurora Navigation Center project which the City of Aurora proposes to apply HOME ARP and American Rescue Plan Act funds (ARPA) funding to the Crown Plaza Hotel located at 15500 E. 40th Ave in Aurora, Colorado 80011. The City of Aurora is proposing to purchase and rehabilitate the Crown Plaza Hotel with HOME ARP and ARPA funds to financially assist with this endeavor. The Crown Plaza Hotel is in very good condition and has all the same amenities that have been planned for a Navigation Campus for those who are experiencing homelessness and more, including 255 rooms, an industrial kitchen, industrial laundry, congregate space, and space for service providers to do case management and other services. Staff is proposing shifting our plans for the Aurora Navigation Campus from the Laredo site to this existing Crown Plaza Hotel, which is only one mile north. The existing space could be renovated and ready to use as soon as summer 2024, which would significantly reduce the timeline to provide additional lifesaving and life-altering services to Aurora’s population of people experiencing homelessness. All of the proposed services from the initial Navigation Campus plans could be offered at the Crown Plaza Hotel and we could offer additional emergency congregate shelter in the convention space to address our increasingly harsh winter season and growing population. The total cost of this project is estimated to be $38,491,454. The City of Aurora will contribute $5,000,000 in ARPA funds and $3,277,861 in HUD HOME ARP funding for a total contribution of $8,277,861. 

HOME Investment Partnerships Program (or HOME) fundings legal authority is under Title II Section 288 of the Cranston-Gonzalez National Affordable Housing Act (as amended).  

AMERICAN RESCUE PLAN ACT OF 2021 (ARPA) funding legal authority is H.R. 1319 an Act To provide for reconciliation pursuant to title II of S. Con. Res. 5

FINDING OF NO SIGNIFICANT IMPACT

The City of Aurora has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Aurora’s Municipal Center located at 15151 E. Alameda Pkwy and may be examined or copied weekdays 8 A.M to 5 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Sarah Carroll City of Aurora, Community Development Division, 15151 E. Alameda, Aurora, Colorado, 80012; or [email protected].  For questions and additional information please contact Sarah Carroll at the above address or call 303-739-7900. All comments received by April 14, 2024 will be considered by the City of Aurora prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The City of Aurora certifies to HUD that Sarah Carroll in her capacity as Housing and Community Development Supervisor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the name of the grant recipient to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the City of Aurora certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Aurora; (b) the City of Aurora has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Noemi Ghirghi, CPD Region VIII Director, at [email protected]. 2024 Community Investment Financing Program
Spring Round

The city of Aurora will open applications for the 2024 spring round of the Community Investment Financing Program at 8 a.m. MST, Thursday, Feb. 28, 2024. The purpose of the Community Investment Financing Program is to provide financial resources for developers interested in creating and/or preserving affordable housing opportunities in Aurora. Applications will be evaluated based on alignment with the policies and goals of the Aurora Housing Strategy found at AuroraGov.org/HousingStrategy. It is expected that applications for the Community Investment Financing Program spring 2024 round will be extremely competitive. Not all applications will receive awards.

The following funds are made available for developers to support the city’s housing goals included in the Housing Strategy for  the spring 2024 round. If applying for multiple funds, developers must submit a separate application for each fund.

  • HOME Funds – $2,020,501
  • CDBG – $2,724,202
  • Private Activity Bonds - $24,617,884

The City of Aurora, as a participating jurisdiction and recipient of the Community Development Block Grant (CDBG), Community Development Block Grant Cares Act (CDBG CV), Home Investment Partnerships Act (HOME), Emergency Solutions Grant Cares Act (ESG CV), and Emergency Solutions Grant (ESG) funds from the U.S. Department of Housing and Urban Development (HUD), shall provide citizens, public agencies, and other interested parties with reasonable access to records regarding any use of or any assistance provided with these funds during the preceding five years.  In addition, before submitting its annual performance report on housing and community development activities, the City shall provide citizens with an opportunity to comment on the performance report before submission to HUD.

A draft copy of the 2023 Consolidated Annual Performance and Evaluation Report (CAPER) can be reviewed in the Community Development offices on the fourth floor of the Aurora Municipal Center at 15151 E. Alameda Pkwy, Aurora, CO 80012, as well as the website listed below.  A finalized version can be viewed after February 15, 2024. The Aurora Municipal Center facility is accessible and can accommodate persons with disabilities.

A public hearing will be held on Tuesday, March 12, 2024, at 6:00 PM during the Citizens Advisory Committee on Housing and Community Development. The hearing will be held at 15151 E. Alameda Parkway, Aurora, Colorado 80012 in the Aurora Room of the Aurora Municipal Center. Residents are encouraged to attend and provide their comments on the DRAFT FY2023 CAPER.

Citizens, public agencies, and other interested parties shall have until 5:00 PM, Friday, March 15, 2024, to provide written comments regarding the CAPER. Please contact the Community Development Division if you require language translation services or other special accommodations.
